AI and Liability – The Lawyer’s View
Artificial intelligence (“AI”) holds great promise, but it also poses new safety risks for users when embedded in products or services. Many people challenge the adequacy of today’s tort or extra-contractual liability regimes in the face of this new technology. The absence of clear safety provisions in the law also creates legal uncertainty for businesses that are marketing AI products. For now, there is little certainty; hence, in the spirit of Plato that an “opinion is the medium between knowledge and ignorance”, we decided to produce two opinions from two different viewpoints as to how AI and liability should be dealt with until there will be knowledge or at least more legal certainty.

Liability during the Lifecycle of an AI Tool
The lifecycle of an AI tool encompasses three main stages: (i) the development phase, which consists of the design and manufacturing and the initial training and validation phase, (ii) the use phase and (iii) the liquidation phase. In each stage different stakeholders are involved. If an AI tool causes harm, liability needs be allocated to one or several stakeholder(s). Which stakeholders are liable for the damage caused depends on (a) the stage of the lifecycle of the AI tool in which the damage occurred and (b) the nature and cause of the damage.

The EU White Paper on Artificial Intelligence – What Does It Mean for AI Developers?
Artificial Intelligence («AI») has and will continue to have an increasing impact on our everyday lives. Although AI in general is only at its inception phase, when it comes to medicine it already has a track record in particular in terms of pattern recognition. The application of machine learning systems may even help to develop and fight the current Covid-19 crisis. At the same time, this adds to the need to find out how AI should be addressed from a legal perspective, which the European Union («EU») White Paper on Artificial Intelligence intends to outline.
