Timmy Pielmeier | INGRES | The jurisdiction of national courts and the European Court of Justice on Copyright Law

Timmy Pielmeier, Associate to MLL Legal’s Intellectual Property team in Zurich, spoke on 5 February 2024 at the Swiss Association for Intellectual Property Laws (INGRES) conference on the practice of Intellectual Property law in Europe – presided by the Zurich Partner Michael Ritscher – about the jurisdiction of national courts and the European Court of Justice on Copyright Law.

European copyright law is – even more than usually – in turmoil. No less than three preliminary questions, two of which concern the very core of European copyright law, are newly pending in Luxembourg and await a hopefully detailed and illuminating decision by the CJEU.

The presentation highlighted the opportunities and risks of the current situation and outlined an optimistic outlook to the future. The hope is that Luxembourg will resolve some of the most pressing uncertainties in copyright law, in particular the requirements for the protection of works of applied art and the relationship between Copyright and Design Law.

The pending judgements have the potential to provide a high degree of legal certainty for rights holders and the opportunity to further harmonise member state copyright law in the interests of the single internal market.
