MLL successfully represented an international group of companies in ICC arbitration proceedings
A three-member ICC arbitral tribunal dismissed the counterparty’s claims in their entirety.
The counterparty was a former consultant, who had provided consultancy services with regard to a public tender in the nuclear sector, in which our client had participated as a bidder. Although our client did not succeed in the tender, the consultant claimed the full success-based remuneration. He alleged that our client had deliberately avoided to be awarded the contract, thereby depriving him in bad faith of his remuneration. The arbitral tribunal dismissed the consultant’s claims in their entirety.
