MLL Legal achieves landmark victory

The Swiss Federal Supreme Court has granted justice to a client represented by Lukas Bühlmann and Walter Häberling by declaring a decades-old practice of the Swiss customs authorities illegal under international law (violation of the free trade agreement with the EU).

Our team, which included also Michael Reinle during the internal administrative proceedings, had to prevail against great resistance, also from the Federal Administrative Court. The latter had always expressly supported the (illegal) customs practice, according to which certificates of origin could no longer be submitted after the goods had crossed the border. However, free trade agreement law still allows this up to 2 years later, in order to promote duty-free treatment under free trade agreement law. This MLL Legal victory is all the more significant today.

The judgment will be published in the official collection of decisions of the Federal Supreme Court.
