FRORIEP advised Dr. Bettina Stefanini and Mr. Vital Stefanini
On June 13, 2018, the Swiss Federal Supreme Court presented its final judgement in a long legal dispute between the old board of the foundation “Stiftung für Kunst, Kultur und Geschichte (SKKG)” and the descendants of Bruno Stefanini, Dr. Bettina Stefanini und Mr. Vital Stefanini.
The Swiss Federal Supreme Court confirmed that the descendants of the founder will have the exclusive right to appoint the members of the foundation’s board. At the same time, it was noted that the foundation’s statutes cannot be changed if the electoral system for the designation of the foundation board of the descendants shall be replaced by an electoral system of co-optation by the foundation board.
