Swiss Arbitration Association Conference on 21 March 2023

MLL Legal partner Jean Marguerat and Alexandra Johnson, Co-chairs of the Geneva group of the Swiss Arbitration Association (ASA), are organizing a conference in Geneva on the subject of Arbitration and the European Union on 21 March 2023. The event will take place at the office of the Geneva Chamber of Commerce, Industry & Services (CCIG).

The relationship between international arbitration and the European Union is varied and illustrates the tensions that exist between the autonomy of the will that is at the heart of arbitration and the EU’s desire to guarantee the proper functioning of the common market and the European judicial area.

The conference will dive into several interesting topics such as:

  • Intra-European investment arbitration excluded by the Court of Justice of the European Union following the Achmea judgment
  • the problems linked to the exclusion of arbitration from the scope of the Brussels I bis Regulation / Lugano Convention (parallel proceedings, anti-suit injunctions, interim measures, etc.)
  • the impact of Brexit

After a short introduction, the topic will be moderated by Eva Lein, Professor at the University of Lausanne, and Yann Dehaudt-Delville, Lawyer at Teynier Pic in Paris.

The speeches will be followed by a general discussion during which members of the Group will be able to share their experiences and ask questions.
