The exercise of a right is inadmissible if it is contrary to good faith or abusive. This general and globally applicable legal principle also applies to trademark law. Also under unfair competition law, breaches of honest practices in competition are frowned upon. Bad faith is important both with regard to the validity of trade mark registrations and the enforcement of trade mark claims. Despite its great practical importance, there are still no criteria at the international level that allow an assessment of bad faith in a specific case with sufficient legal certainty. Nevertheless, certain groups of cases are emerging, which will be examined in this workshop.
