The conceptual distinction between foodstuffs and cosmetic products is extremely important from a legal perspective (e.g. with regard to the legality of a product) and, as a result, is regularly addressed in practice, for example recently in the Federal Supreme Court decision 2C_576/2023 of January 18, 2024. In this decision, the Federal Supreme Court had to evaluate – in the sense of an obiter dictum – the relevance factors for distinguishing between foodstuffs and cosmetic products for a CBD oil. On 29 and 30 January 2024, the Swiss Federal Tax Administration published the 2024 editions of the two circulars on safe harbour interest rates. The revised rates in the circulars reflect the sharp drop in long-term interest rates in the major currency areas in the last quarter of 2023. The rate for EUR denominated loans declined to 2.50 % (previous year: 3.00 %), the rate for GBP dropped to 3.75 % (previous year: 5.25 %). The JPY rate remains unchanged at 0.50 %, while the USD rate climbs to 4.25 % (previous year 3.75 %).

On 21 December 2023, Switzerland signed a first-of-its-kind financial services agreement with the UK (Agreement) after two years of talks which began after the UK left the EU. The Agreement uses outcomes-based mutual recognition of each jurisdiction’s financial services regulatory and supervisory regimes to facilitate cross-border trade in financial services to wholesale and sophisticated clients on the basis of deference, domestic law or other arrangements:
