Speaking Engagements
NIS 2 and DORA: Lukas Bühlmann at the ITechLaw European Conference in Copenhagen
Lukas Bühlmann will speak at the ITechLaw 2026 European Conference, held from 21 to 23 October 2026 in Copenhagen.
On 22 October 2026, he will join a panel on “Regulatory and Contractual Issues in the Interplay between NIS 2 and DORA” with Pia Ek (Partner, Bird & Bird), Axel Anderl (Managing Partner, DORDA) and Jürgen Hartung (Partner, Oppenhoff).
The NIS 2 Directive (Directive (EU) 2022/2555) and the Digital Operational Resilience Act (DORA, Regulation (EU) 2022/2554) both set requirements for cybersecurity, ICT risk management and incident reporting. For financial entities, DORA largely takes precedence as the more specific regime. In practice, however, the two regimes meet in many places. ICT service providers that are subject to NIS 2 themselves must also meet the contract requirements their financial-sector customers have to impose under DORA. Groups with both financial and non-financial entities have to align two compliance frameworks. The panel will discuss how the regimes interact and what this means for drafting and negotiating ICT contracts.
Lukas Bühlmann will contribute the Swiss perspective. Switzerland has adopted neither regime, but Swiss companies are affected by both: as ICT providers to EU financial entities, as providers of digital services in the EU within the scope of NIS 2, and as financial groups with EU subsidiaries. They must also comply with Swiss requirements, such as FINMA Circular 2023/1 on operational risks and resilience and, for operators of critical infrastructure, the reporting obligation for cyberattacks under the Information Security Act.
